More Than Just Tuition Terms and Conditions

1. Definitions and Interpretation
In these Terms:
- “Company” means More Than Just Tuition.
- “Client” means the parent, guardian, or individual purchasing tutoring services.
- “Student” means the individual receiving tutoring services.
- “Tutor” means any tutor providing services through the Company.
- “Services” means online tutoring sessions and related educational support.
2. Nature of Services and Tutor Status
2.1 The Company provides online tutoring services for educational support purposes only. No specific academic results, examination outcomes, admissions decisions, qualifications, or certifications are guaranteed.
2.2 Tutoring services are not a substitute for formal education, regulated teaching, therapy, counselling, medical advice, or other professional services.
2.3 Tutors operate as independent contractors and are not employees, agents, or representatives of the Company. To the maximum extent permitted by law, neither the Tutor, nor More Than Just Tuition accept liability for any direct or indirect loss or damage, foreseeable or otherwise, including any consequential, special, or exemplary damages arising from the use of the Tutor's or More Than Just Tuition's services or any errors or omissions in the content of the Tutor's learning materials.
2.4 The Company maintains quality assurance processes and safeguarding oversight but does not exercise day-to-day control over how Tutors deliver sessions.
2.5 All Tutors hold an enhanced DBS certificate registered on the Update Service and maintain up-to-date safeguarding training. Evidence may be provided upon request.
3. Bookings, Payments and Pricing
3.1 Lessons must be booked through the Company's approved scheduling and payment systems.
3.2 Clients may either:
- Pre-pay for a block of lessons; or
- Pay per lesson and be invoiced monthly on the first calendar day of each month (or next working day where this falls on a weekend).
3.3 Week-by-week bookings do not guarantee the same time slot unless a recurring booking has been secured.
3.4 New bookings require at least 48 hours' notice.
3.5 The Company reserves the right to amend pricing upon reasonable notice.
4. Cancellation, Rescheduling and Refunds
4.1 Clients must provide a minimum of 48 hours' notice to cancel a scheduled session.
4.2 Failure to provide the required notice will result in the full session fee being charged, as the time has been reserved exclusively for the Student.
4.3 Where cancellation is made with more than 48 hours' notice:
- The session will not be charged; or
- If already paid, the fee will be credited to the next invoice.
4.4 Rescheduling is subject to Tutor availability and cannot be guaranteed.
4.5 If a Student does not attend due to illness or emergency circumstances beyond their reasonable control, the Company may offer rescheduling at its reasonable discretion.
4.6 If the Tutor is unavailable, the Client will not be charged and any pre-paid fee will be credited or refunded.
4.7 If a session is terminated early by the Client or Student, the full session fee remains payable.
5. Statutory Cooling-Off Rights
5.1 Where Services are purchased online or at a distance, Clients have a statutory right to cancel within 14 days under the Consumer Contracts Regulations 2013.
5.2 If the Client requests that tutoring begins within the 14-day period, they expressly acknowledge that the right to cancel may be lost once Services have been fully performed.
5.3 Where partial Services have been delivered during the cooling-off period, a proportionate charge will apply.
6. Session Conduct and Requirements
6.1 The Client must provide a quiet and suitable learning environment.
6.2 Students must log into sessions at least five minutes before the scheduled start time. If the Student or Client chooses to terminate a Session early (for example, after 30 minutes of a one-hour session), the Session will be charged at the usual price.
6.3 Students under 18 must have an adult present in the home during online sessions.
6.4 Students must be dressed appropriately, behave respectfully, and attend sessions prepared with required materials and completed homework.
6.5 Sessions begin and end at the scheduled time. Late arrival does not guarantee extension of the session.
6.6 Lateness exceeding 20 minutes without reasonable communication may result in cancellation at the Tutor's discretion, with the session fee remaining payable.
6.7 If the Tutor is delayed, reasonable efforts will be made to extend or reschedule the session.
7. Academic Integrity and Acceptable Use
7.1 The Services must not be used for academic dishonesty, including cheating, plagiarism, or completing assessed work on behalf of a Student.
7.2 The Company reserves the right to terminate Services immediately, without refund, where academic misconduct is suspected or identified.
8. Technical Requirements and Third-Party Platforms
8.1 Clients are responsible for ensuring suitable equipment, software, and internet connectivity.
8.2 The Company is not liable for missed or disrupted sessions caused by user-side technical issues. Refunds or credits may be offered at the Company's reasonable discretion.
8.3 The Services may rely on third-party platforms including video conferencing software and payment processors. The Company is not responsible for outages or failures caused by such third parties.
9. Safeguarding, Data Protection and Intellectual Property
9.1 Services are educational in nature. Any pastoral support provided is informal and non-clinical. Tutors are not qualified to provide therapy, medical advice, or psychological treatment.
9.2 Tutors are required to maintain professional boundaries and report safeguarding concerns in accordance with UK safeguarding legislation and the Company's safeguarding policy.
9.3 Parents and guardians remain responsible for the Student's wellbeing outside scheduled sessions.
9.4 The Company processes personal data in accordance with UK GDPR and the Data Protection Act 2018. Further information is available in the Privacy Policy.
9.5 All lesson materials and resources remain the intellectual property of the Company and may not be copied, reproduced, or distributed without written consent.
10. Liability, Force Majeure and Governing Law
10.1 To the maximum extent permitted by law, the Company shall not be liable for indirect or consequential losses arising from the use of the Services.
10.2 The Company's total liability shall not exceed the total fees paid by the Client in the preceding three months.
10.3 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability which cannot be excluded under applicable law.
10.4 Neither party shall be liable for failure or delay in performing obligations due to circumstances beyond their reasonable control, including illness, power failure, internet outages, or government restrictions. Reasonable efforts will be made to reschedule affected sessions. If rescheduling is not possible, the Client will not be charged or will receive a credit or refund.
10.5 These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
11. Communication and Complaints
11.1 The Company may communicate with Clients via email, SMS, telephone, or messaging platforms (including WhatsApp) for matters relating to bookings, reminders, updates, and administrative correspondence.
11.2 The Company will endeavour to respond to enquiries within 24 hours during normal business hours (Monday to Friday, 9am to 8pm), excluding weekends, public holidays, and periods of annual leave.
11.3 Clients may request a progress update from the Tutor on a monthly basis. The Company will endeavour to provide written feedback within 48 hours of such request.
11.4 The Company is committed to providing high-quality tutoring services. If a Client is dissatisfied with any aspect of the Services, they should notify the Company in writing as soon as reasonably practicable.
11.5 Complaints will be acknowledged within 48 hours and investigated promptly. The Company will use reasonable endeavours to resolve complaints in a fair and proportionate manner.
11.6 Where appropriate, and subject to availability, an alternative Tutor may be offered if the relationship between the Client and Tutor has irretrievably broken down.
